1. Acceptance of Terms

These Terms of Service form a contract between you and Sefaja, the operator of Saymail. Our company details are listed on theImprint page. By purchasing, downloading, or using Saymail — the desktop application (Windows, macOS, or Linux), the Android application, or the iOS application — you agree to be bound by these Terms of Service. If you do not agree, do not use the software.

2. License Grant

Upon purchase, we grant you a non-exclusive, non-transferable license to use Saymail on up to 5 computers that you own or control, for personal or business use; the Android and iOS applications are licensed for your personal devices. The license is granted for the supported lifetime of the product as commercially distributed by Sefaja, and remains in effect until terminated under Section 12.

The license covers the Saymail desktop and mobile (Android and iOS) applications. AI-powered features (including, but not limited to, classification, smart compose, summarization, AI-powered rules, and the MCP server) require either (a) a locally hosted language model that you operate yourself, (b) an API key that you obtain directly from a third-party AI provider (such as Anthropic, OpenAI, or Google), or (c) Saymail Cloud credits purchased separately. The one-time purchase price does not include AI usage.

3. Restrictions

You may not:

• Redistribute, resell, or sublicense Saymail
• Reverse-engineer, decompile, or disassemble the software
• Remove or alter any copyright or proprietary notices
• Use the software for unlawful purposes
• Share your license key publicly

4. Free Use of the Application

The Saymail application is provided free of charge, with no time limit and with no obligation to purchase anything. No registration, account or payment method is required to install and use it. This is not a limited or time-boxed evaluation version.

Paid products are optional add-ons that relate to AI functionality: Saymail Cloud credits, a one-time bring-your-own-AI license, and the Cloud Sync subscription. Section 5 describes each of them.

5. Payment and Pricing

5.1 Bring-your-own-AI License

The bring-your-own-AI license is sold as a one-time purchase at the price listed at the time of purchase. It permits the application to be configured to use an AI provider or model of your own choosing, on the number of devices stated at the time of purchase, and it does not include any Saymail Cloud credits. All prices are in euros (EUR) and are presented inclusive of any applicable VAT or sales tax at checkout. We may change prices at any time, but changes will not affect existing purchases.

5.1.1 Merchant of Record

Sales are processed by Lemon Squeezy, which acts as the Merchant of Record and is responsible for collecting and remitting applicable VAT and sales tax, issuing invoices and refunds, and handling payment processing. Order receipts will name Lemon Squeezy as the seller of record.

5.2 Saymail Cloud Credits

Credits pay for AI requests routed through Saymail Cloud and are consumed on a pay-as-you-go basis; one credit covers one request, and a request that fails is not charged. A free grant of credits is provided with each installation and repeated periodically at our discretion; that grant confers no entitlement and may be changed or withdrawn for future periods. Purchased credits do not expire. Pack pricing is shown at checkout. We may change credit pricing at any time; previously purchased credits retain their value.

5.2.1 Cloud Sync Subscription

Cloud Sync is a recurring subscription billed monthly or annually at the price shown at checkout, renewing until cancelled. It includes synchronisation of AI-derived data between your devices, the bring-your-own-AI entitlement, and a periodic credit grant in the amount stated at the time of purchase. On cancellation, access continues until the end of the period already paid for. If a renewal payment fails, synchronisation is suspended while the bring-your-own-AI entitlement remains available; no data is deleted as a result. One subscription per person is permitted, and it covers all of that person's devices.

5.3 Third-Party AI Charges (BYOK)

If you configure Saymail with your own API key from a third-party AI provider, all charges from that provider are your sole responsibility. We do not control or moderate those charges and are not a party to your agreement with the provider.

5.4 Mobile App Purchases (App Store and Google Play)

Saymail is also distributed through the Apple App Store and Google Play. Subscriptions, credit packs, and other in-app purchases made through those stores are billed and collected by Apple or Google, respectively — not by Sefaja. The store platform is the seller of record for those transactions: prices, payment processing, tax collection, invoicing, and refunds are governed by the relevant store's terms of service and refund policy, and you must direct payment or refund requests for store purchases to the store from which you bought them.

6. Refund Policy and Right of Withdrawal

6.1 Statutory right of withdrawal (EU consumers)

If you are a consumer resident in the EU/EEA, you have a statutory 14-day right of withdrawal under Directive 2011/83/EU (the Consumer Rights Directive) for any purchase made from us. The application itself is free of charge, so the right of withdrawal concerns only the paid add-ons described in section 5, which are digital content. By purchasing one and starting to use the software (e.g., activating it on a computer or installing an update), you expressly consent to immediate performance and acknowledge that, to the extent the digital content has been supplied to you, you lose the right of withdrawal for the portion already supplied. This consent is collected explicitly at checkout.

6.2 Saymail satisfaction guarantee

In addition to your statutory rights, we offer a voluntary 14-day satisfaction guarantee on the application license. To request a refund, contact us atsupport@saymail.eu. Refunds are processed by our Merchant of Record, Lemon Squeezy, to the original payment method.

6.3 Saymail Cloud credits

Saymail Cloud credits that have already been consumed are non-refundable. Unconsumed credits may be refunded within 14 days of purchase, prorated to the unused balance. By purchasing credits and beginning to use them, you expressly consent to the supply of digital content and acknowledge that you lose the right of withdrawal for credits that have been consumed.

6.4 Statutory rights unaffected

Nothing in this Section 6 limits any rights you have under mandatory consumer protection law in your country of residence.

7. Updates

Your license entitles you to receive updates to Saymail for as long as Saymail is commercially distributed by Sefaja, at no additional cost. We make no guarantee about the frequency or scope of updates and do not commit to any minimum support period beyond what is required by mandatory consumer-protection law.

8. Affiliate Program

Participation in the Saymail Affiliate Program is subject to additional terms. We reserve the right to modify commission rates, terminate affiliate accounts for fraud or abuse, and withhold payouts pending investigation.

9. Data and Privacy

Your use of Saymail is also governed by our Privacy Policy. Your email data is stored locally and is your responsibility to back up. Business customers can request a Data Processing Agreement atprivacy@saymail.eu.

9.1 Crash and error reporting

The Saymail desktop application may transmit redacted crash and error reports to Sentry (Functional Software, Inc., d/b/a Sentry) so we can diagnose and fix bugs. Events are redacted client-side before transmission as described in our Privacy Policy. By using Saymail you acknowledge this limited diagnostic transmission.

9.1.1 Mobile application analytics

The Android and iOS applications contain no product analytics by default. If you choose to enable "Send usage data" (which is off unless you opt in), the mobile application sends pseudonymous product-usage events as described in our Privacy Policy. By using the mobile applications you acknowledge this limited, opt-in transmission.

9.2 Website analytics

Our website may use PostHog (PostHog, Inc.) for privacy-friendly product analytics, but only after you have given consent through the cookie banner. The analytics script is not loaded if you reject or ignore the banner. The Saymail desktop application does not contain product analytics.

9A. AI Features and Output

9A.1 AI features rely on third-party language models or models you operate locally. Output is generated probabilistically and may be inaccurate, incomplete, or unsuitable for a particular purpose. You must independently verify any AI output before relying on it, particularly for legal, medical, financial, or other consequential decisions.

9A.2 You are responsible for the content you submit to AI models, including ensuring you have the right to share that content and that doing so does not violate confidentiality obligations, applicable law, or the terms of the AI provider you use.

9A.3 We do not guarantee availability, performance, or continued support of any specific AI provider or model. Provider outages, deprecations, or policy changes may temporarily or permanently affect AI features. We may add, remove, or substitute supported providers at our discretion.

10. Disclaimer of Warranties

Saymail is provided "as is" without warranties of any kind. We do not guarantee uninterrupted or error-free operation. AI-generated content is provided "as is" and without warranty of accuracy, fitness, or non-infringement. We disclaim all liability for decisions made on the basis of AI output.

11. Limitation of Liability

To the maximum extent permitted by law, our total liability for any claim arising from your use of Saymail shall not exceed the amount you paid for the software.

12. Termination

We may revoke your license if you violate these Terms. Upon revocation, you must stop using Saymail and delete all copies.

13. Changes to Terms

We may update these Terms from time to time. Continued use of Saymail after changes constitutes acceptance of the new Terms.
